A Win for Licensees re Minor Agent Testing
This is a win for liquor licensees:
Following pressure to be fully transparent regarding the positive compliance history of licensees, LCRB have taken a much welcome step by issuing the following communication:
“To improve transparency, the LCRB will now automatically email licensees within 14 days after a MAP compliance check at their establishment to inform them that they passed. Only licensees who refuse service to a minor agent will receive these notifications as recognition of their diligence to serve responsibly.
Licensees who sell liquor or cannabis to a minor agent will be contacted by their LCRB inspector.
Please note that the email notification will not include specific details such as the date and time of the inspection or any information about the LCRB staff involved. This is to help maintain the integrity and credibility of the program.”
Where Licensees and their staff have been inspected by LCRB and found to be compliant, this is clear evidence of due diligence; and is extremely valuable to licensees who ever face allegations of non compliance in the future. This is especially true in cases like service to minors, where ‘due diligence’ is normally the only defence open to Licensees.
Whether you are a client of ours, or not – If you are licensee, we strongly advise you to secure any notification that you receive from LCRB confirming positive compliance with your own records.
If you receive a notification from LCRB alleging that you have been non compliant, please reach out to discuss options as soon as possible. We offer a Due Diligence program that helps protect your licence, and supports your staff deliver best service, while remaining fully compliant.
In the wake of this communication being issued by LCRB it is best to assume that the Spring / Summer round testing by Minor Agents is on it’s way; and it is a great time to remind staff about the program – Please note – If you have failed a test before, it is their policy to re-test you…..
